2. The data We collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

• With affiliates: We may share your information with our affiliates, in which case We will require those affiliates to honor this privacy policy. Affiliates include our subsidiaries, joint venture partners or other companies that We control or that are under common control with us.

We require all Third Parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

19. Glossary

LAWFUL BASIS

Consent means where you have given explicit consent for the processing of your personal data.

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). • Service providers acting as processors based in Egypt or the Middle East who provide IT and system administration services.
• Professional advisers acting on behalf of the Company including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services to the Company.
• Egyptian Tax Authority and other authorities based in the Arab Republic of Egypt who require reporting of processing activities in certain circumstances.

4- كيف نستخدم بياناتك الشخصية

سنستخدم بياناتك الشخصية فقط عندما يسمح لنا القانون بذلك. وبشكل عام،

نستخدمها في الحالات التالية:

• عند الحاجة لتنفيذ التزاماتنا بموجب عقد نحن بصدد إبرامه معك أو سبق أن أبرمناه؛
• عندما يكون ذلك ضروريًا لمصالحنا المشروعة (أو مصالح طرف ثالث)، ولا تتعارض تلك المصالح مع حقوقك الأساسية؛
• عندما نحتاج إلى الامتثال لالتزام قانوني.

بشكل عام، لا نعتمد على موافقتك كأساس قانوني لمعالجة بياناتك الشخصية، إلا عند إرسالنا مواد تسويقية مباشرة من أطراف ثالثة عبر البريد الإلكتروني أو الرسائل النصية، حيث نحصل على موافقتك المسبقة.

ويحق لك سحب هذه الموافقة في أي وقت بالتواصل معنا.

5- الأغراض التي من أجلها نستخدم بياناتك الشخصية

لقد قمنا بتحديد الأغراض التي نستخدم من أجلها بياناتك الشخصية في الجدول أدناه، بالإضافة إلى توضيح الأساس القانوني الذي نعتمد عليه في كل حالة. كما أدرجنا المصالح المشروعة التي نعتمد عليها، إذا كانت مناسبة.

يرجى ملاحظة أننا قد نقوم بمعالجة بياناتك الشخصية استنادًا إلى أكثر من أساس قانوني واحد، وذلك حسب الغرض المحدد الذي نستخدم بياناتك من أجله. إذا كنت بحاجة إلى تفاصيل عن الأساس القانوني الذي نعتمد عليه في معالجة بياناتك الشخصية، في الحالات التي تم فيها ذكر أكثر من أساس واحد في الجدول أدناه، يُرجى التواصل معنا.

6- التسويق

نحن نسعى لتوفير خيارات لك فيما يتعلق باستخدام بعض بياناتك الشخصية، لا سيما فيما يخص التسويق والإعلانات.

7- العروض الترويجية من قبلنا

يجوز لنا استخدام بيانات الهوية، وبيانات الاتصال، والبيانات التقنية، وبيانات الاستخدام، وبيانات الملف الشخصي لتكوين فكرة عما قد ترغب به أو تحتاجه أو ما قد يثير اهتمامك. وهكذا نحدد المنتجات والخدمات والعروض التي قد تكون ملائمة لك (ويُشار إلى ذلك بالتسويق).

سوف تتلقى اتصالات تسويقية منا إذا كنت قد طلبت معلومات منّا أو اشتريت خدمات منا ولم تقم بإلغاء الاشتراك من تلك الرسائل التسويقية.

8- التسويق من قبل أطراف ثالثة

لن نقوم بمشاركة بياناتك الشخصية مع أي طرف ثالث لأغراض تسويقية دون الحصول على موافقتك الصريحة والمسبقة.

9- إلغاء الاشتراك

يمكنك أن تطلب منا أو من الأطراف الثالثة التوقف عن إرسال الرسائل التسويقية إليك في أي وقت، وذلك بإلغاء تفعيل الخانات المخصصة أو عن طريق التواصل معنا مباشرة.

إذا قمت بإلغاء الاشتراك، فإن هذا لا ينطبق على البيانات الشخصية التي تم تقديمها لنا نتيجة لشراء خدمة أو تسجيل ضمان أو تجربة منتج/خدمة أو غيرها من المعاملات.

10-ملفات تعريف الارتباط (Cookies)

يمكنك ضبط متصفحك لرفض جميع ملفات تعريف الارتباط أو بعضها، أو لإخطارك عند محاولة المواقع تعيين ملفات تعريف الارتباط أو الوصول إليها. إذا قمت بتعطيل أو رفض ملفات تعريف الارتباط، قد تصبح بعض أجزاء هذا الموقع غير قابلة للوصول أو لا تعمل بالشكل الصحيح.

11- تغيير الغرض من الاستخدام

سنستخدم بياناتك الشخصية فقط للأغراض التي تم جمعها من أجلها، ما لم نعتبر بشكل معقول أن هناك حاجة لاستخدامها لغرض آخر يتوافق مع الغرض الأصلي.

إذا رغبت في الحصول على شرح لكيفية توافق المعالجة للغرض الجديد مع الغرض الأصلي، يُرجى التواصل معنا.

إذا احتجنا إلى استخدام بياناتك الشخصية لغرض غير ذي صلة، فسنقوم بإبلاغك وتوضيح الأساس القانوني الذي يسمح لنا بذلك (إن وجد). ولن نقوم باستخدام بياناتك لهذا الغرض دون موافقتك الخطية المسبقة.

يرجى ملاحظة أنه يجوز لنا معالجة بياناتك دون علمك أو موافقتك، بما يتوافق مع القوانين، في الحالات التي يجيزها أو يفرضها القانون.

12- الإفصاح عن بياناتك الشخصية

يجوز لنا مشاركة بياناتك الشخصية مع الأطراف التالية للأغراض الموضحة أعلاه:

• "الأطراف الثالثة" كما هو مذكور في قسم "القاموس".
• أطراف ثالثة قد نقوم ببيع أو نقل أو دمج أجزاء من أعمالنا أو أصولنا معها. وقد نستحوذ على شركات أخرى أو نندمج معها. في حال حدوث تغيير في هيكل العمل، قد يستخدم المالكون الجدد بياناتك الشخصية بنفس الطريقة المنصوص عليها في سياسة الخصوصية هذه.
• مع الشركات التابعة لنا: يجوز لنا مشاركة بياناتك مع الشركات التابعة لنا، وفي هذه الحالة سنطلب من هذه الشركات الالتزام بسياسة الخصوصية هذه. وتشمل الشركات التابعة الشركات الفرعية أو الشركاء في المشاريع المشتركة أو أي كيان آخر نملكه أو نتحكم فيه أو يقع تحت نفس السيطرة.

نطلب من جميع الأطراف الثالثة احترام أمن بياناتك الشخصية ومعالجتها بما يتفق مع القانون. ولا نسمح لمزودي الخدمة من الأطراف الثالثة باستخدام بياناتك لأغراضهم الخاصة، بل فقط لمعالجتها وفقًا لتعليماتنا وللأغراض المحددة.

13- حماية البيانات

لقد قمنا باتخاذ التدابير الأمنية المناسبة لمنع فقدان بياناتك الشخصية عرضًا أو استخدامها أو الوصول إليها بطريقة غير مصرح بها أو تعديلها أو الإفصاح عنها. كما أننا نقيّد الوصول إلى بياناتك على الموظفين والوكلاء والمقاولين والأطراف الثالثة الذين لديهم حاجة تجارية مشروعة لمعرفة تلك البيانات. ويخضع هؤلاء لالتزامات السرية ويعالجون البيانات فقط بناءً على تعليماتنا.

نحن نعتبر حماية بياناتك أولوية قصوى. ونلتزم بمبدأ عدم مشاركة البيانات دون موافقة صريحة. ويقتصر استخدام البيانات على أغراض تحسين تجربتك ضمن "بُكرة". كما نحرص على حفظ البيانات بطريقة آمنة ومحمية من أي وصول غير مصرح به.

وقد وضعنا إجراءات لمعالجة أي خرق محتمل للبيانات الشخصية، وسنقوم بإبلاغك والجهات التنظيمية المختصة إذا لزم الأمر قانونًا.

مع ذلك، نذكّرك أن أي طريقة نقل عبر الإنترنت أو تخزين إلكتروني ليست آمنة %100. على الرغم من حرصنا على استخدام وسائل مقبولة تجاريًا لحماية بياناتك، لا يمكننا ضمان حمايتها الكاملة. ننصحك بتأمين حسابك باستخدام كلمات مرور قوية وتمكين المصادقة الثنائية.

14- الاحتفاظ بالبيانات

إلى متى سنحتفظ ببياناتك الشخصية؟

سنحتفظ ببياناتك الشخصية فقط للمدة الضرورية والمناسبة لتحقيق الأغراض التي جمعناها من أجلها، بما في ذلك الوفاء بأي التزامات قانونية أو تنظيمية أو ضريبية أو محاسبية أو إبلاغية. يجوز لنا الاحتفاظ ببياناتك الشخصية لفترة أطول في حال وجود شكوى أو إذا كنا نعتقد بشكل معقول أن هناك احتمالاً لرفع دعوى قضائية فيما يتعلق بعلاقتنا بك.

لتحديد مدة الاحتفاظ المناسبة، نأخذ بعين الاعتبار طبيعة البيانات وحساسيتها، وخطر الأذى الناتج عن الاستخدام أو الإفصاح غير المصرح به، والأغراض التي نعالج البيانات لأجلها، وما إذا كان يمكن تحقيقها بوسائل أخرى، بالإضافة إلى المتطلبات القانونية والتنظيمية والضريبية والمحاسبية ذات الصلة.

يجب علينا الاحتفاظ بالمعلومات الأساسية عن عملائنا (بما في ذلك بيانات الخاصة بالهوية والخاصة بالاتصال والخاصة بالمعاملات والبيانات المالية) لمدة (خمس) سنوات بعد توقفهم عن أن يكونوا عملاء، وذلك لأغراض ضريبية.

في بعض الحالات، يمكنك أن تطلب منا حذف بياناتك. (راجع "حقوقك القانونية" أدناه لمزيد من التفاصيل).

وفي بعض الحالات، سنقوم بإخفاء هوية بياناتك الشخصية (بحيث لا يمكن ربطها بك) لأغراض البحث أو التحليل الإحصائي، وفي هذه الحالة يمكننا استخدام تلك البيانات إلى أجل غير مسمى دون إخطارك.

15- حقوقك القانونية

في ظل ظروف معينة، لديك حقوق بموجب قوانين حماية البيانات فيما يتعلق ببياناتك الشخصية. الرجاء الضغط على الروابط المحددة أدناه لمعرفة المزيد عن هذه الحقوق:

• طلب الوصول إلى بياناتك الشخصية.
• طلب تصحيح بياناتك الشخصية التي نحتفظ بها.
• طلب محو بياناتك الشخصية.
• الاعتراض على معالجة بياناتك الشخصية.
• طلب تقييد معالجة بياناتك الشخصية.
• طلب نقل بياناتك الشخصية.
• الحق في سحب الموافقة.

16-عدم وجود رسوم عادةً

لن تضطر إلى دفع أي رسوم للوصول إلى بياناتك الشخصية (أو لممارسة أي من حقوقك الأخرى). ومع ذلك، قد نفرض رسومًا معقولة إذا كان طلبك لا أساس له أو مكررًا أو مفرطًا. وبدلاً من ذلك، يمكننا رفض تلبية طلبك في مثل هذه الحالات.

17-ما قد نحتاجه منك

قد نطلب منك تقديم معلومات محددة لمساعدتنا في تأكيد هويتك وضمان حقك في الوصول إلى بياناتك الشخصية (أو لممارسة أي من حقوقك).

يُعد هذا إجراءً أمنيًا لضمان عدم الإفصاح عن البيانات الشخصية لأي شخص لا يحق له الحصول عليها. وقد نتواصل معك أيضًا لطلب مزيد من المعلومات المتعلقة بطلبك لتسريع الاستجابة.

18-المدة الزمنية للرد

نسعى إلى الرد على جميع الطلبات المشروعة خلال ستة أيام عمل.

ومع ذلك، قد يستغرق الأمر أكثر من شهر في حال كان طلبك معقدًا أو تضمن عدة طلبات.

في هذه الحالة، سنقوم بإبلاغك وإطلاعك على تطورات المعالجة.

19- القاموس

الأساس القانوني

الموافقة: تعني موافقتك الصريحة على معالجة بياناتك الشخصية.

المصلحة المشروعة: تعني مصلحتنا في إدارة وتسيير أعمالنا بطريقة تُمكننا من تقديم أفضل خدمة أو منتج وتجربة أكثر أمانًا.

نحن نحرص على دراسة وتقييم أي تأثير محتمل عليك (سواء إيجابي أو سلبي) قبل الاعتماد على المصلحة المشروعة.

ولا نستخدم بياناتك الشخصية في أنشطة تتعارض مصالحنا فيها مع حقوقك، (إلا إذا حصلنا على موافقتك أو كان القانون يسمح بذلك). يمكنك طلب تفاصيل إضافية عن كيفية موازنتنا بين المصلحة المشروعة والتأثيرات المحتملة عليك من خلال التواصل معنا.

تنفيذ العقد: تعني معالجة بياناتك عندما يكون ذلك ضروريًا لتنفيذ عقد تكون طرفًا فيه أو لاتخاذ خطوات بناءً على طلبك قبل إبرام العقد.

الامتثال لالتزام قانوني: تعني معالجة بياناتك عندما يكون ذلك ضروريًا للامتثال لالتزام قانوني نخضع له.

الأطراف الثالثة

• مقدمو الخدمات الذين يعملون كمعالِجين للبيانات، ويقع مقرهم في جمهورية مصر العربية أو منطقة الشرق الأوسط، والذين يقدمون خدمات تكنولوجيا المعلومات وخدمات إدارة الأنظمة.
• المستشارون المهنيون الذين يعملون نيابةً عن الشركة، ويشملون المحامين، والمصرفيين، والمدققين، وشركات التأمين، الذين يقدمون خدمات استشارية ومصرفية وقانونية وتأمينية ومحاسبية للشركة.
• مصلحة الضرائب المصرية وغيرها من الجهات الحكومية المختصة في جمهورية مصر العربية والتي قد تطلب تقارير عن أنشطة معالجة البيانات في بعض الحالات.

حقوقك القانونية

يحق لك ما يلي:

طلب الحصول على بياناتك الشخصية (المعروفة عادةً باسم "طلب صاحب البيانات"). يتيح لك هذا الحصول على نسخة من البيانات الشخصية التي نحتفظ بها عنك والتأكد من أننا نقوم بمعالجتها بشكل قانوني.

طلب تصحيح بياناتك الشخصية التي نحتفظ بها. يتيح لك هذا تصحيح أي بيانات غير مكتملة أو غير دقيقة نحتفظ بها عنك، مع العلم أننا قد نحتاج إلى التحقق من دقة البيانات الجديدة التي تقدمها.

طلب محو بياناتك الشخصية. يمكّنك هذا من أن تطلب منا حذف البيانات الشخصية أو إزالتها عندما لا يكون هناك سبب وجيه لاستمرارنا في معالجتها. لديك أيضًا الحق في أن تطلب منا حذف بياناتك الشخصية أو إزالتها في حالة ممارستك بنجاح لحقك في الاعتراض على المعالجة (انظر أدناه)، أو في حالة قيامنا بمعالجة معلوماتك بشكل غير قانوني أو في حالة مطالبتنا بمسح بياناتك الشخصية للامتثال للقانون المحلي. ومع ذلك، يرجى ملاحظة أننا قد لا نكون قادرين دائمًا على الامتثال لطلبك بالمحو لأسباب قانونية محددة سيتم إخطارك بها، إذا لزم الأمر، في وقت تقديم طلبك.

الاعتراض على معالجة بياناتك الشخصية عندما نعتمد على مصلحة مشروعة (أو مصلحة طرف ثالث) وهناك شيء ما في وضعك الخاص يجعلك ترغب في الاعتراض على المعالجة على هذا الأساس لأنك تشعر أنها تؤثر على حقوقك وحرياتك الأساسية. لديك أيضًا الحق في الاعتراض عندما نقوم بمعالجة بياناتك الشخصية لأغراض التسويق المباشر. في بعض الحالات، قد نثبت أن لدينا أسبابًا مشروعة مقنعة لمعالجة معلوماتك والتي تتجاوز حقوقك وحرياتك.

طلب تقييد معالجة بياناتك الشخصية، يتيح لك هذا أن تطلب منا تعليق معالجة بياناتك الشخصية في السيناريوهات التالية:

• إذا كنت تريد منا التأكد من دقة البيانات.
• إذا كان استخدامنا للبيانات غير قانوني، ولكنك لا ترغب في حذفها.

• إذا كنت قد اعترضت على استخدامنا لبياناتك، ولكننا نحتاج إلى التحقق مما إذا كانت لدينا مبررات قانونية تفوق اعتراضك.

طلب نقل بياناتك الشخصية إليك أو إلى طرف ثالث. سنقدم لك، أو لطرف ثالث اخترته، بياناتك الشخصية بتنسيق منظم وشائع الاستخدام وقابل للقراءة آليًا. يرجى ملاحظة أن هذا الحق ينطبق فقط على المعلومات الآلية التي وافقت في البداية على استخدامها أو حيث استخدمنا المعلومات لتنفيذ عقد معك.

سحب الموافقة في أي وقت نعتمد فيه على الموافقة لمعالجة بياناتك الشخصية. ومع ذلك، لن يؤثر هذا على قانونية أي معالجة يتم إجراؤها قبل سحب موافقتك. إذا قمت بسحب موافقتك، فقد لا نتمكن من تقديم منتجات أو خدمات معينة لك. سننصحك إذا كان هذا هو الحال في وقت سحب موافقتك.
